Are brothels legal in Victoria?

Short answer: yes. Brothels are legal in Victoria, and since decriminalisation they no longer need a special licence to operate. A sex services business is now treated like any other business in the state, which is a bigger change than it first sounds.

What changed, and when

Victoria passed the Sex Work Decriminalisation Act in February 2022. It came in two stages. The first set of changes started on 10 May 2022, and the old Sex Work Act 1994, along with its licensing system, was fully repealed on 1 December 2023. What decriminalisation actually means

Under the old model, a brothel needed a licence from a state regulator, and running one without it was a criminal offence. That system is gone. A sex services business can now operate anywhere an ordinary shop can, subject to the same planning and business rules as any other trade. The public health provisions that singled out brothels were repealed, and workers are covered by the same workplace laws as everyone else. In plain terms, the state stopped treating it as a special category and started treating it as work.

What it means if you’re visiting

Day to day, not much changes for a client, except that the whole thing now sits on firmer legal ground. Venues across Melbourne and the suburbs, Richmond, South Melbourne, Dandenong, Nunawading and the CBD among them, operate openly. You still book, still pay the venue’s fee, still agree anything else privately with the worker. The difference is that none of it is happening in a legal grey zone anymore.

Where limits still apply

Decriminalised does not mean anything goes. Planning rules still decide where a venue can set up. General criminal law applies in full, so coercion, anyone under 18, and trafficking are serious offences and always will be. There are still rules around advertising. The reform legalised consensual adult work between willing people; it didn’t touch the laws that protect people from exploitation.
